SA CYBERLAW / ICT CONFERENCE 2009

Prospective speakers are hereby requested to forward (by e-mail or fax) to the Conference Chair, Sizwe Snail an Abstract and / or a draft paper for consideration (model abstract attached) by the end of February 2009 at the details below.

A response on the abstract will be sent by send week of February 2009 and final conference papers (accepted papers) will have to be submitted the 25th June 2009.

This year’s theme is “Practical application of Cyberlaw in different environments”, however this will not specifically limit the scope of papers presented and applicable or topical papers are welcome. Kindly forward this call for paper to other academics and practitioners who are willing to take part in this year's convention. Companies, individuals or institutions interested in becoming part of this exciting event are welcome to make proposals to the Conference Chair.  Further details, Conferences fee prices and the exact conference dates will be given by e-mail and in the press.

Model Abstract :

“An overview of South African e-consumer law in the context of the Electronic Communications Transactions Act (ECT)”

This paper’s main focus will be on the law regulating the interaction and legal relationship between electronic consumers (e-consumers) and electronic merchants  (e-merchant) / electronic vendor (e-vendor) and or electronic suppliers of goods and services. (E-suppliers of goods and services). To lay a basis for the discussion we will briefly investigate the enforceability and validity for of electronic contracts (e-contracts). Furthermore, we will define an e-consumer, as defined in the ECT. This will be followed by an expose on the requirements of ECT website compliance and how they operate within the legal framework. The paper will also look into the provisions pertaining to the e-consumers rights and obligation with special regard to consumer law as well as the general principles of the law of contract. The paper will also investigate problems created by the ‘choice of law ‘principle and the different dispute resolutions mechanisms as well as possible solutions to current lacunae in the law.
